Terms of Service

These Terms of Use (“Terms”) govern your use of the KIRIKOM services provided by INFOEYE Co., LTD. (“Company”). These services include kirikom.net, kirikom.plus, infoeye.com/selfpicks, and related platforms such as kirikom.jp, plus.kirikom.jp, itf.kirikom.jp, and file-pack.com (collectively, the “Services”). By using the Services, you (“User”) agree to be bound by these Terms.

1. Service Overview and Registration: The Services include image clipping and editing on behalf of Users, as well as cloud-based tools for streamlining apparel operations (e.g., product management, inventory control, order processing, and the “Selfpicks” exhibition tool). Users must register to access the Services, providing accurate and complete information. The service contract is deemed concluded once the User receives a user ID and password from the Company. The Company may deny registration without obligation to disclose reasons. Users under the age of majority must have consent from a legal guardian.
2. User registration: Account Management Users must maintain the confidentiality of their ID and password. Unauthorized sharing, transfer, or disclosure is prohibited. Users are responsible for all activities performed using their credentials. In case of suspected unauthorized use, Users must notify the Company immediately. The Company is not liable for any damages resulting from User negligence.
3. Prohibited Conduct Users may not:

• Reverse-engineer or redistribute the Services or software
• Interfere with the Services (e.g., transmitting malware, overloading servers)
• Infringe intellectual property, privacy, or other rights
• Defame or harm others, spread falsehoods
• Distribute obscene, discriminatory, or otherwise offensive content
• Use the Services for unlawful or unrelated purposes
• Engage in any conduct deemed inappropriate by the Company Violations may result in suspension or termination of access without notice or refund.

4. Paid Services and Fees Some features are fee-based, offered through a point system or monthly subscription. Consumption tax is added separately.

Point System:

• Points are purchased in advance and used for various services (1 point = ¥1 before tax)
• Volume discounts may apply
• Points do not expire
• No refunds unless required by law

Subscription Plans:

• Free Plan: Up to 100 SKUs
• Basic Plan: ¥3,000/month (excl. tax), includes up to 10,000 SKUs and one session
• Add-ons:
  • ¥2,000/month per extra session
  • ¥2,000/month per additional 10,000 SKUs
  • ¥2,000/month per 1GB of extra storage
• Payment is made in advance via credit card or designated methods
• Auto-renews monthly unless cancelled
• Fee changes will be notified in advance and apply from the next renewal

5. Plan Changes Upgrades take effect on the same or next business day, with prorated charges. Downgrades are applied three months after request and remain at the current plan rate during the transition.
6. Cancellation and Termination

• Users may cancel paid plans before the contract end date to avoid renewal
• Mid-term cancellations do not result in refunds
• Upon cancellation, access is limited to Free Plan functionality
• Account deletion results in permanent removal of data after a certain period
• The Company may suspend or terminate accounts without notice if these Terms are violated, with no refunds

7. Intellectual Property All intellectual property related to the Services belongs to the Company or its licensors. Users receive a non-exclusive, non-transferable license for personal use only. Unauthorized reproduction or use is prohibited.

• The names “KIRIKOM” and “Selfpicks,” domain names, and logos are trademarks of the Company.
• User-uploaded content remains the property of the User. However, the Company may use such data as necessary to provide the Services (e.g., backup, processing), without claiming ownership.

8. Disclaimers

• The Company does not guarantee completeness, accuracy, usefulness, or availability of the Services
• Users use the Services at their own risk
• The Company is not liable for data loss, service interruption, or indirect damages
• Users must manage their own data backups
• The Company is not responsible for disputes between Users and third parties, but reserves the right to seek compensation if involved due to User conduct

9. Governing Law and Jurisdiction These Terms are governed by the laws of Japan. Disputes will be exclusively submitted to the Tokyo District Court or Tokyo Summary Court as the court of first instance.
10. Amendments The Company may modify these Terms at its discretion. Changes will be notified at least 14 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
